 One of the fundamental Principles in the Law of Tort is ‘He who comes to nuiscance cannot complain of nuiscance’. This Section 19 Hindu temple has been in existence for about 200 years. In the words of the Bilal of the Section 19 Mosque, ‘ Kuil ini wujud lama sebelum Shah Alam dibangunkan ‘(Berita Keadilan, 13 September 2009 di muka surat 3) Why should this historical and heritage temple of the Indian plantation community of Shah Alam be relocated elsewhere or to the controversial Section 23 site in the first place. IF need be the Selangor State government should compulsorily acquire the houses nearby, pay them compensation and create the ‘space’ or ‘buffer’ if that was what the residents had wanted. In the first place these houses should not have been built so close to the hindu temple during the UMNO controlled Selangor State government regime. Now that it had been built, it is only fair that the PKR led Selangor State government undo this injustices by retaining this hindu temple at it’s original site. This will be a win win solution for all and prove that there is genuine co-existence and true multi racial and multi religious harmony in Selangor, Malaysia as opposed to being merely racial and religious tolerance. Why should this minority be tolerated vis a vis their hindu temple.

 

Had it been the other way around and this hindu temple been a mosque surrounded by Indian and hindu residents as is the case in the brand new mosque in Jalan Sultan Abdul Samad Brickfields, will Tan Sri Khalid and UMNO push for the mosque to be relocated? After all Article 8 of the Malaysian Federal Constitution provides for equality before the law and equal protection under the law and Article 11 of the same provides for freedom of religion.

 

We therefore urge your goodselves the PKR led P.R Selangor State government to retain this historical and heritage hindu temple of the Indian plantation workers in Selangor as it is and where it is in Section 19, Shah Alam, Selangor, Malaysia.
