UMNO High Court Judge denies Hindraf registration without hearing merits, 46,780 other NGOs approved.Upholds UMNO ROS’s absolute powers & above the law attitude.

This Hindraf Makkal Shakti’s application to be registered as a legal NGO is just the latest of the scores of Public Interest Litigation cases that the UMNO High Courts and right up to the Federal Courts has struck out mostly without even hearing the merits of the case beginning with the Kampong Medan racial attacks case of Subramaniam v Suhakam (government of Malaysia way back in 2001.

The UMNO High Court Judge Abang Iskandar bin Abang Hashim decided that as the registration of Hindraf as an NGO therefore this application to the High Court is frivolous, vexatious and an abuse of the process of the courts and this Hindraf civil suit dismissed with costs of RM 3,000 payable to One Malay-sia Prime Minister Najib Razak, Home Minister and the Registrar of Societies of K.L and Putrajaya .

P. Uthayakumar had earlier on 21/6/2011 submitted that if the High Court dismisses this Hindraf civil suit it would give legitimacy to the UMNO Registrar of Societies to remain in the above the law mindset ie they are not duty bound to even reply to any letter or Hindraf’s application. This would also give legitimacy to the UMNO Registrar of Societies not being answerable to the general public in their discharge of their public duties. What more giving legitimacy to the impression of the absolute powers of the Registrar of Societies.

It was within our contemplation that  this UMNO High Court Judge Abang Iskandar bin Abang  Hashim would under the Prime Minister Najib Razak’s orders dismiss this our application as he had done in the 2007 Hindraf Rally era when he ‘fixed up” three Hindraf lawyers including P. Uthayakumer & P. Waythamoorthy to stand trial for sedition at Klang Courts .

Hindraf would file an appeal to the Court of Appeal.

Irrespective of this High Court decision Hindraf would defy this High Court order or UMNO and would continue to operate as usual.


This is the UMNO brand of law and order in One malay-sia. When Hindraf applies to be registered  as a legal NGO, the UMNO Registrar of Societies refuse to even reply let alone approving Hindraf as an NGO.

And when we continue operating as a pro tem NGO as per our Constitutional Right to form Associations as per Article 10 (1) (c) of the Federal Constitution, 54 Hindraf has thus for been prosecuted for being a member of Hindraf, an unlawful NGO.

And now when we come to the Malay-sian Courts this rejection of even leave to register Hindraf as and NGO is made. So what do we do? Become an underground movement?

All of this only shows one thing. The neo colonialist UMNO regime is simply frightened of the magical Hindraf and HRP. Otherwise why approve 46,780 other NGOs’ and 31 political parties with no problems and single out Hindraf and HRP for rejection.

Irrespective our struggle for the Indian poor continues.

P. Kanapathy (38) will be forced to abandon his wife and four children aged between 4 to 8 years old for 20 long years and to suffer a couple of strokes of the rotan for an offence of attempted rape that he did not commit. It is merely the racist Malay-sian police allegation and coupled with the racist UMNO Attorney General Tan Sri Gani Patail’s blatant abuse of powers, this Indian man will be eventually also be forced to plead guilty as he has neither the money for bail nor legal fees for his lawyers. So he and his family including his wife and 4 to 8 aged old children are doomed to  suffer lifelong.

The law of any civilized country requires a fair and impartial trial and to have been properly represented by a lawyer of his choice who is fully paid by the government.

Thereafter if he is sentenced to jail, so be it.

But this is the due process of the law.

Not by the racist UMNO A.G. and racist Polis Raja Di Malay-sia arm twisting this poor and one individual Indian man to plead guilty versus the entire weight and might of the whole country .

As if the 3 years jail meted out on him is not enough punishment.

25 நவம்பர் 2007 அன்று ஒரு லட்சம் இந்தியர்கள் கோலாலம்பூர் மாநகரில் திரண்ட அந்த வரலாற்று பூர்வ நிகழ்விற்கு வித்திட்டது இந்த விருந்தாகும். மக்கள் சக்தி என்ற மாபெரும் எழுச்சி உணர்வலை இங்கேதான் தற்செயலாக விதைக்கப்பட்டது. ஆனாலும், அந்த எழுச்சி உணர்வலை மிக சிறிய அளவில் தான் அந்த விருந்தோம்பலில் உணரப்பட்டது.

மலேசிய இந்திய மக்களிடையேயும் இதர சமூகத்தினரிடையேயும் என் போராட்டம் வெற்றி பெறவில்லையே என்ற துக்கத்தில் நான் இருந்த சமயம் அது. அவ்வேளையில் என் உரையை கூர்ந்து கேட்கும் என் சகோதர சகோதரிகளை கண்டு நான் ஆச்சரியப்பட்டு போனதில் வியப்பில்லை தான். 2001 ஆம் ஆண்டு கம்போங் மேடானில் இந்தியர்களுக்கு எதிராக நடத்தப்பட்ட இன படுகொலையின் பொழுது நான் தன்னந்தனியாக நின்று பாதிக்கப்பட்ட மக்களுக்கு ஆதரவாக குரல் கொடுத்தேன். சாதாரண உடையில் இருந்த மலேசிய பாதுகாப்பு படையினரும் மற்றும் அம்னோ ஏவிவிட்ட அடியாட்களும் கம்போங் மேடானில் வாழ்ந்து வந்த இந்தியர்களுக்கு எதிராக இன படுகொலையை வெற்றிக்கரமாக நடத்தியது. மலாய் முஸ்லிம் கும்பல் இந்த இரத்தக் களரியை நடத்தியது. 100க்கும் மேற்பட்ட அப்பாவி மக்கள் இந்நிகழ்வில் படுகாயம் அடைந்தனர்.

70 abducted by ‘policemen’ have vanished (see Free Malaysiatoday)

More than 70 people have gone missing after they were taken away by ‘policemen’, never to be seen again, Pakatan MPs said.

KUALA LUMPUR: More than 70 people are believed to have been abducted by “policemen”, Pakatan Rakyat MPs alleged. DAP Ipoh Barat MP M Kulasegaran said that these people were last seen led away by plainclothes “policemen”.

“Something dreadful has happened to them while on the way to police stations… they were led away in the company of people armed with the stuff of law enforcement,” he told reporters in the Parliament lobby yesterday.

Kulasegaran said that these people then disappeared, never to be seen again.  He added that more than 70 separate police reports have been lodged in the last eight months with regard to the matter.

In one example, he said that “two or three men” appeared at a Gunong Rapat house near Ipoh last week.

“Claiming they were police personnel … they produced police identity papers, carried handcuffs and were armed with firearms. But they were not in uniform and arrived in unmarked vehicles,” said Kulasegaran.

He heard about the case from the couple’s family members. When he inquired about the couple’s fate at the Ipoh police station, he found out that the police did not call them in for questioning.

“They had no dealings with the police… No connections whatsoever!” said Kulasegaran.

Similar circumstances

PKR Kapar MP S Manickavasagam said that he knew of a Subang Jaya businessman who disappeared under similar circumstances in June.

“His family came to my office, and we sent a memorandum to the Inspector-General of Police (Ismail Omar), lodged three police reports, but until now he’s (still) missing,” he said.

Manickavasagam added that the businessman had not left the country as his passport was still in his house.

He added that he had heard of four similar cases through DAP Puchong MP Gobind Singh Deo.

Kulasegaran filed a motion on the matter on Monday. However, it was rejected in Dewan Rakyat Speaker Pandikar Amin Mulia’s Chambers yesterday.

In a letter to Kulasegaran, Pandikar Amin said that the police were investigating the matter, and did not consider the motion as urgent for debate.

A disappointed Kulasegaran said: “Contrary to the views of the Speaker, the motion should have been debated as the police could have explained the factors… why to date over 70 people have gone missing.”

“At first, we thought it was just a normal (case of) missing people. But many of them are in their 40s or their 50s.”

He suspected that many of these missing people were most likely murdered. He said that the police were also not serious in investigating these cases, saying: “When we went and lodged the police report, they themselves cannot synchronise.”

Hindraf fails in suit against ROS (FreeMalaysiaToday)

The Kuala Lumpur High Court said the Registrar of Societies has not made a decision on Hindraf’s application for registration and as such there was no case against it.

PETALING JAYA: The Kuala Lumpur High Court today dismissed Hindraf Makkal Sakthi’s application to quash the Putrajaya and Federal Territories Registrar of Societies’ (ROS) decision for not allowing the registration of Hindraf Makkal Sakthi with costs.

In his verdict, Judge Abang Iskandar Abang Hashim said the ROS has yet to make a decision on the registration and therefore there was no case against it.

In April, Hindraf Makkal Sakthi filed a suit against ROS for failing to register the non-governmental organisation despite being given 14 days to provide an answer to the status of the application.

The NGO submitted its application to the ROS in October 2009.

Also named in the suit were Prime Minister Najib Tun Razak and Home Minister Hishammuddin Hussein.

When contacted, Hindraf pro tem secretary general P Uthayakumar said the judge’s ruling showed that the ROS was above the law.

“ROS never even filed an affidavit in the court but the judge said it was immaterial. He never even gave us a proper hearing. This is against the rule of natural justice,” Uthayakumar said.

He criticised the authorities for being biased against Hindraf.

“About 54 of our members were arrested for being in an illegal organisation. When we apply for registration, they don’t reply and when we go to court, they dismiss us,” he said.

Uthayakumar said he will file an appeal against the ruling today and vowed to exhaust all legal means to get Hindraf registered.

“Over 14,000 NGOs and 31 political parties were registered with no issues. Why single out Hindraf?”asked Uthayakumar.
