This morning the Human Rights Party (HRP) suit to be registered as a political party was dismissed by the Kuala Lumpur High Court Judge (Special Powers and Appellate Division) Dato Rohana binti Yusof with costs of RM 2,500.

P. Uthayakumar informed the court this morning that the Registrar of Societies (ROS) had vide their letter dated 4/8/2011 but served on HRP on 10/8/11 notified HRP that their application to be registered  political party is rejected on two grounds:-

1) In very vague and general terms stating that the application is not in order.

2) That the HRP Constitution fails the requirements of the ROS.

But the said ROS letter did not specify how the application was not in order when they had acknowledged receipt of all the documents submitted and never replied to HRP stating how the application was not in order. Obviously the ROS did not want to specify as there was nothing not in order and as they do not want HRP to resubmit in order (which is denied).

And this racist KL High Court decision is despite the fact that the HRP Constitution is a 99% mirror adoption of the DAP Constitution, the only difference being the Chairman’s post being called President in HRP, and there being no Vice Chairman, Deputy Treasurer etc.

This decision by the Registrar of Societies Malaysia it tantamount to saying that about the oldest political party in Malaysia, the DAP’s 34 year old constitution is not in order.

The truth is the racist and facist UMNO ROS and Home Minister do not know what they are doing and are merely creating lame excuses in refusing to register HRP as a lawful political party and to deny HRP Registration so that HRP would not be able to contest in the 13th General Elections. UMNO’s calculation is so that HRP will be denied the opportunity to champion the cause of the Indian poor at the highest political level.

To this effect the racist and facist UMNO Prime Minster Najib Razak, Home Minister, Attorney General Tan Sri Gani Patail and the ROS are using the 97% Malay muslim dominated biased Malay-sian ROS and Judiciary to strike out HRP’s civil suit. And to punish HRP for daring to challenge UMNO Malay muslim racist and supremacist agenda the K.L. High Court today imposed costs of RM 2,500, when the Senior Federal Counsel Nadia Tajuddin asked for costs of RM 3,000.

Despite Uthayakumar’s submissions that HRP would be filing an appeal from this decision of the Registrar of Societies  to Home Minister Datuk Seri Hishamuddin Tun Hussin this week and in anticipation of another rejection to register HRP, and HRP filing another High Court Civil Suit, and that both the present and intended Civil Suits should be heard together and therefore this matter is to be adjourned to a three month mention date, the Judge had rejected this application on the basis that the Court cannot go on an anticipated decision.

This UMNO High Court  decision is despite Uthayakumar submitting that it is no fault of HRP as it was the UMNO ROS that had refused to reply to HRP which the High Court Judge had agreed at the first Hearing date, and ROS had acted as if they are above the law and acted with impunity. Had the ROS replied there would be no need for HRP to file this High Court civil suit in the first place.

See how plain and obvious UMNO uses the Judiciary to stifle legitimate dissent and the cry of freedom, equal rights and equal opportunities against the Indian poor in Malay-sia.
