Four days ago Syamala Devi Mani,a final year medical student in Lasi, Romania called our Ganeson Gunalan to thank us for highlighting her financial predicament in even borrowing from loan sharks in completing her sixth and final year medical studies. And even after her studies her medical degree is refused to be recognized by the racist UMNO 1 Malay-sia regime when the British General Medical Council (BGMC) and the European Union recognizes her Medical degree. This also the case with the medical degrees in Russia, India, Indonesia, Ukraine, Romania, Checkoslvakia etc.

Why? Why this level of UMNO racism in 1 Malay-sia and never seen or heard any other part of the world? Which religion teaches this?

Having been segregated and denied places in the local Universities and overseas JPA scholarships to do medicine over the last 54 year, Indian poor parents utilize their lifelong savings, pension funds, EPF, sell their land, houses, beg, borrow and send their children to study medicine in Russia, India, Indonesia, Ukraine, Romania, Checkoslavakia, as the tution fees in these countries are lower. These Indian parents soil, toil and cut corners and suffer working hard and long hours so that their children will not lead the miserable lives they lead and will have a better live.

But look at how the racist, facist and supremacist UMNO regime throws sand into the ricebowl of these Malaysian ethnic Indian medical students simply because they are the Indian poor and the UMNO agenda is reduce the total number of ethnic Indian medical students from 60% in 1957 to an estimated 5% today and targeted to be reduced to 1% by the 2020 Wawasan UMNO.

See how UMNO hampers the upward mobility opportunities of these Indian poor and does so with racist impunity.

Going backwards 40 years ago even the highly regarded Judges of the apex Federal Court Tun Suffian Raja Azlan Shah, Salleh Abbas, rejected the setting up of the MCA and Chinese philanthropist first private University. See how UMNO has been using the Courts to stifle upward mobility opportunities.

But in the last 40 years the rich and powerful Chinese community who control some 60% of the Malaysian economy have their private Inti, Rima, Curtin, TAR, KDU, Taylors College, Sunway, etc and/or have the money to send their children for studies overseas.

But for the academically weak Indian poor youths, the UMNO regime even refuses to taken them into the 213 Giatmara Skills Training Colleges nationwide, hundreds of Vocational Colleges, Technical Colleges and Community Colleges which are almost 100% exclusively  for only the Malay muslims but what is otherwise touted as 1 Malay-sia by UMNO Prime Minister Najib Razak.

And the pin drop silence by the pseudo multi-racial Opposition Leaders, NGO’s civil society etc.

Even Technical, Vocational and Skills Training opportunities denied to Indian poor youths by racist UMNO.


Indian poor youths to start off with are denied entry into the 213 Giat Mara Skills Training Institutes. Where some 140,000 Malay muslims only youths get to graduate mostly within walking distance from their homes.

But the Indian poor youths are segregated into a token one or two odd Indian wayang kulit Skills Training Colleges using the MIC mandore Manpower Minister etc.
Our question is, why not entry into all 213 Giat Maras, Vocational schools and Technical Colleges that all the Malay muslims get to enter?

You name it, right from S. Tharmarajen, (2001) Vivashanu Pillai, V.Vikines, Mohanan Pillai, Muniandy Subramaniam, et al, the 98% Malay muslim dominated 1 Malay-sian Courts TKO dismissed our civil suits for being frivolous, vexatious and an abuse of the process of the Courts.

Besides not getting single cent award by the 1 Malay-sian Courts the police and prison wardens murderers got away scot free when even the Attorney General refuse to prosecute them because they are Malay muslims.

Kami merujuk kepada perkara yang tersebut diatas, kepada permohonan anakguam kami yang bertarikh 18/3/2011 kepada Pendaftar Pertubuhan Wilayah Persekutuan dan kepada surat penolakan Jabatan Pendaftaran Pertubuhan Malaysia yang bertarikh 22/9/2011 yang telah secara tidak sah disisi Perlembagaan Persekutuan dan Akta Pertubuhan 1966 menolak permohonan Hindraf Makkal Shakti untuk diluluskan dan didaftarkan sebagai sebuah Badan Bukan Kerajaan (Sesalinan surat yang bertarikh 22/9/2011 tersebut dilampirkan bersama disini untuk rujukan senang pihak tuan.)

Jabatan Pendaftaran Pertubuhan Malaysia sama sekali tidak menyatakan alasan/alasan untuk penolakan permohonan Hindraf Makkal Shakti untuk sekurang-kurangnya memberi peluang kepada anakguam kami untuk memperbetulkan yang tidak teratur dan (jika perlu) sekali lagi membuat permohonan kepada Jabatan Pendaftaran Pertubuhan Malaysia untuk pendaftaran Hindraf Makkal Shakti sebagai sebuah Badan Bukan Kerajaan.

Tindakan Jabatan Pendaftaran Pertubuhan ini adalah satu tindakan yang tidak adil, tidak bebas dari “arahan politik”, mala-fide, mempunyai niat serong dan bermotifkan politik dengan tujuan menghalang Hindraf Makkal Shakti dari terus memperjuangkan nasib malang masyarakat India yang miskin.

Oleh yang demikian, kami dengan ini membuat rayuan ini menurut terutamanya tetapi tidak terhad kepada Artikel 10(1)(c) Perlembagaan Persekutuan dan Seksyen 18(b) dan dibaca bersama dengan Seksyen 7 Akta Pertubuhan 1966 kepada pihak Y.B. Menteri Dalam Negeri supaya Hindraf Makkal Shakti diluluskan dan didaftarkan sebagai sebuah Badan Bukan Kerajaan dalam tempoh masa empat-belas (14) hari dari tarikh disini.

Menurut keputusan Mahkamah Persekutuan Malaysia, Artikel 10(1) Perlembagaan Persekutuan dalam otoriti Sivarasa Rasaiah v Majilis Peguam Negara [2010] 2 MLJ 333 telah memutuskan yang “ The articles which guarantee fundamental liberties shall be read broadly, whereas any provisions of restriction over the fundamental liberties shall be read narrowly. Then the restrictions on the fundamental liberties should not make those guaranteed rights to be illusionary and ineffective. The fundamental liberties are the basic structure of the Federal Constitution and Parliament cannot enact laws which violates this basic structure.

Sila ambil perhatian bahawa jika pihak Y.B. Menteri Dalam Negeri enggan dan / atau cuai dan / atau gagal memberi kelulusan kepada dan mendaftarkan Hindraf Makkal Shakti sebagai sebuah Badan Bukan Kerajaan menurut terutamanya Artikel 10(1)(C) Perlembagaan Persekutuan dan dibaca bersama dengan Seksyen 7 dan Seksyen 18(b) Akta Pertubuhan 1966 dalam tempoh empat-belas (14) hari dari tarikh surat ini kami akan andaikan yang permohonan kami ini telah ditolak pada 15/10/2011 dan kami akan meneruskan dengan prosiding Mahkamah Tinggi untuk antara lain satu Perintah Certiorari dan Mandamus tanpa sebarang Notis lagi kepada pihak Y.B. Menteri.

Sila ambil perhatian bahawa kami juga akan dalam permohonan yang sama membuat satu “ additional alternative prayer” memohon untuk perintah Certiorari dan Manadamus terhadap sebarang keputusan bertulis Y.B. Menteri Dalam Negeri (jika ada) dimana permohonan Hindraf Makkal Shakti ini pada kemudian hari ditolak oleh pihak Y.B. Menteri sebagaimana yang telah dilakukan melalui surat yang bertarikh 22/9/2011 tersebut oleh Pendaftar Pertubuhan Malaysia.

Report: MIC still in ‘critical’ condition, Hindraf rules. (see FMT 30.9.11)


According to a report by the Prime Minister’s Office, only three out of the nine Parliament seats the party is eyeing for are considered safe bets.

KUALA LUMPUR: A report from the Prime Minister’s Office reveals that MIC is still in a precarious position.

The party, which now has a new president after 30 years in G Palanivel, will probably be facing its toughest election battle yet. It must regain the ground it lost in the last polls.

In the 2008 general election, MIC only won three parliament and seven state seats out of the nine and 19 contested.

Last year, MIC’s P Kamalanathan added another MP seat to the stable when he defeated PKR candidate Zaid Ibrahim in the Hulu Selangor by-election.

According to the report from the PM’s Office, only three out of the nine Parliament seats could be considered safe for MIC. The three were Cameron Highlands (Pahang), Hulu Selangor (Selangor) and Tapah (Perak).

Party vice-president and Deputy Minister in the PM’s Department SK Devamany is the incumbent Cameron Highlands MP whereas another vice-president and Federal Territory and Urban Well-Being Deputy Minister M Saravan holds the Tapah seat.

Speaking to FMT, a senior officer from the PM’s Department, who declined to be named, said that MIC would face an uphill task in the next election.

“Palanivel is expected to maintain all of the winners in the last election in their respective seats despite earlier rumours of Devamany being dropped to make way for the president and Saravanan to compete in Kapar,” he said.

As for the other seats, the officer classified Segamat (Johor), Teluk Kemang (Negrei Sembilan) and Sungai Siput (Perak) as “semi-critical”. The other three seats Subang, Kapar and Kota Raja were expected to be retained by the opposition.

Segamat is a crucial seat as it housed MIC deputy president and Human Resources Minister Dr S Subramaniam.

The trouble with this constituency, according to the officer, was the 51% Chinese voters. The latter are predominantly pro-opposition.

Picking the right candidates

The officer stated that for MIC to remain relevant it must field candidates who were accepted by the people and those who would work for the interest of all races.

“No matter if the candidates are old, new or middle-aged as long as they can win,” he added.

Meanwhile, a party insider claimed that the party had already prepared a list of names for the general-election.

However, he stressed that the candidates must be familiar with the initiavies and programmes carried out by Prime Minister Najib Tun Razak’s administration.

He conceded that some of the candidates and party leaders were in the dark about these issues and this would jeopardise the party’s chances.

“For example, the candidates needs to know the government’s initiatives on subsidies, loans, grant programmes, affordable housing (PPRT), food, health care and so on,” he said.

He also urged Palanivel to respect the wishes of the grassroots with regard to selecting candidates.
