At the height of the 25^th November 2007 Hindraf Rally, P. Uthayakumar was repeatedly arrested and finally prosecuted for Sedition at the Kuala Lumpur High Court on 11/12/2007 for his allegation of using the word (social) “ethnic cleansing” of the Indian poor in his letter to then British Prime Minister Gordon Brown.

The High Court had last year dismissed Uthayakumar’s application to declare the charges unconstitutional especially in contravention of Article 10 of the Federal Constitution  which guarantees freedom of speech.
