KUALA LUMPUR: Lawyer P. Uthayakumar is applying to subpoena former British Prime Minister Gordon Brown as a witness in relation to a 2007 incitement case against him.

He filed the application at the Kuala Lumpur High Court civil registry yesterday through his lawyer M. Manoharan.

Uthayakumar, 50, is seeking to call Brown as his name was mentioned in a seditious letter the lawyer was alleged to have sent.

He is seeking to interview, take instructions from and have Brown to act as a witness in his sedition trial at the Sessions Court here.

In the application, Uthayakumar said his counsel applied for a similar subpoena at the Kuala Lumpur Sessions Court civil registry on June 29 but it was denied.

He said Manoharan had also sent a letter to London-based law firm Dotcom Solicitors to apply to the British High Court to deliver the subpoena to Brown should the local court grant his application.

“If the KL court denies this application, we will appeal,” Uthayakumar told reporters at the court complex yesterday.

On Dec 17, 2007, Uthayakumar claimed trial to a charge of publishing a seditious letter addressed to Brown on the Police Watch Malaysia website between Nov 15 and Dec 8, 2008.
