Re: Prime Minister and Home Minister must withdraw 2007 declaration that Hindraf is illegal and register Hindraf & HRP in the spirit of High Court decision that declared Bersih legal.
We refer to the above matter.
We welcome the decision by the Kuala Lumpur High Court Judge Datuk Rohana Yusof declaring Bersih as lawful and setting aside the decision of the Home Minister declaring Bersih as lawful.
However we wish to point out that this very same Kuala Lumpur High Court had on 30/6/11 dismissed Hindraf Makkal Shakti’s application for a Writ of Mandamus to compel the Home Minister to register Hindraf Makkal Shakti as a lawful society with cost of RM 3,000.00. Similarly the Kuala Lumpur High had on 19/6/2012 dismissed with cost of RM 3,000.00 Hindrafs’ political wing the Human Rights Party’s (HRP) application for Judicial Review to quash the decision of the Home Minister dated 23/3/12 (who in turn had upheld the decision of the Registrar of Societies dated 4/8/2011) in rejecting HRPs’ application to be a registered political party.
The Court of Appeal had on 17/7/2012 also similarly dismissed Hindraf Makkal Shakti’s application to be a registered Non Governmental Organization (NGO) with costs of RM 5,000.00. Hindraf lawyers would next week be filing an application for leave to appeal to the Federal Court accordingly while HRPs’ appeal to the Court of Appeal is pending Hearing.
In the interim in the spirit of yesterday’s (24/7/2012) High Court decision declaring Bersih, as legal and as was reported in most of today’s (25/7/12) mainstream dailies and the front pages of the Tamil dailies the present governments’ transformation programme and in view of the fact that 46,870 other NGO’s and 33 other political parties have been registered according to the website of the Registrar of Societies, we hereby call upon the your goodselves to forthwith approve the legal registration of Hindraf and the Human Rights Party.
More so as 54 Hindraf activists nationwide are facing criminal prosecution at the Ipoh, Selayang, Kuala Lumpur and Seremban Magistrates Courts and facing up to two (2) years jail for merely being members of Hindraf that had been declared an illegal organization. Whereas Article 10 (1) (c) of the Federal Constitution guarantees freedom of association.
