Kuala Lumpur High Court Judge (Criminal 1) Dato Azman bin Hussien today (30/7/2012) dismissed P. Uthayakumar’s application for an Interim stay of proceedings at the Kuala Lumpur Sessions Court pending two appeals and two Notice of Motions to the High Court amongst others for:-
1. Representations has been made to the Prime Minister, Dato Seri Najib Tun Razak, law Minister Nazri Aziz and Attorney General Tan Sri Gani Patail that the Sedition charge against Uthayakumar be withdrawn in view of the to be repealed Sedition Act 1948 and the new National (Symphony Orchestra!) Harmony Act.
2. The Sedition Act against P. Uthayakumar is groundless according to Section 173 (g) of the Criminal Procedure Code
3. The recusal of the Sessions Court Judge who has dismissed up to 34 questions in one day by P. Uthayakumar in Cross Examination of Sarawak Chief Police Officer DCP Dato Acryly Sani bin Abdullah Sani who in 2007 (date of charge) was Federal Criminal Investigations Department Deputy Director and all Uthayakumar’s application were also rejected.
4. The recusal of the Deputy Public Prosecutor Noorin Badaruddin for being vindictive and is a potential witness in the trial.
Manoharan Malayalam represented P. Uthayakumar while Noorin Badaruddin and P.G Cyril appeared for the Attorney General.
The High Court Judge then fixed 27th August 2012 as the case management date of the main Notice of Motion application.
