Federal Court Malay-sia dismisses P. Uthayakumar’s 215 pages Sedition Review application without even A.G Gani Patail replying to affidavit: UMNO govt political directions? Not end of road. Another Federal Court Review to be filed when Sedition Act repealed.
P. Uthayakumar’s lawyer M. Manoharan submitted praying for an Order at the Malay-sian apex Federal Court that in the light of at he Prime Minister Dato Seri Najib Tun Razak and Law Minister’s legal transformation policy change announcement as follows:-
a) Lebih kurang dua (2) minggu selepas daripada keputusan Mahkamah Persekutuan dalam menolak Rayuan jenayah Hasutan di sini pada tarikh 25/6/2012, melalui satu pengumuman umum perubahan polisi kerajaan oleh Ketua Penggubal Undang-undang merangkap Y.A.B. Perdana Menteri Malaysia Dato Seri Najib Tun Razak telah mengumumkan pemansuhan Akta Hasutan 1948 era penjajah British olehkerana telahpun menjadi outdated dan “obsolete” dan telah memberi jaminan berkenaan kebebasan bersuara yang telahpun dijamin dibawah Artikel 10(1) (a) Perlembagaan Persekutuan sejajar dengan polisi transformasi Undang-Undang Malaysia (Rujukan: New Straits Times and Utusan Malaysia headlines dated 12 July 2012).
(b) Melalui satu lagi pengumuman umum perubahan polisi kerajaan berikutnya oleh Menteri yang bertanggungjawab mengenai Penggubalan Undang-undang merangkap Menteri di Jabatan Perdana Menteri (De facto Law Minister) Dato Seri Nazri Tan Sri Aziz yang dilaporkan berkata " The National Harmony Act, which replace the Sedition Act 1948 allows criticism of government and leaders in the effort to guarantee freedom of speech as enshrined in the country’s constitution, said Minister in the Prime Minister’s Department Datuk Seri Mohd Nazri Abdul Aziz. He said under the Sedition Act, this was not permitted. “The Sedition Act has a provision of not allowing the raising of anger against the government, but now we have discarded it. “Criticisms leveled at the government and leaders are legitimate as freedom of speech is guaranteed under the Constitution. We should face the criticism by the people as this will serve as a check and balance for the government to realize its weaknesses, he said……. (New Straits Times dated 15 July 2012 at page 16 reporting the National News Agency Bernama report).
Despite the above 1 Malay-sia’s apex Federal Court Judge Richard Malanjum, Hashim Bin Dato’ Haji Yusoff, Ahmad Bin Haji Maarop, Sulong Matjeraie, Jeffry Tan dismissed P. Uthayakumar’s application for leave to review the Federal Court’s earlier decision dated 25/6/2012.
The Federal Court had then dismissed P. Uthayakumar’s application that the Sedition Act 1948 is not ultra vires the Federal Constitution and that the Sedition charges against P. Uthayakumar is not dismissed
M. Manoharan also submitted that the pre independence colonial era 1948 Sedition Act is obsolete.
In dismissing P. Uthayakumar’s application the Judges unanimously held that this has to be in a “different forum” and a blanket (kosong) that the requirements of Section 137 of the Supreme Court Rules has not been fulfilled without giving any reasons for this Judgement. What is the ratio decided will never be known a la 1 Malay-sian Justice.
UMNO 1 Malay-sian government directive?
When met by reporters outside the Courtroom, M. Manoharan said that this is not the end of the road as when the Sedition Act is repealed P. Uthayakumar would apply for another Federal Court Review in the light of the amended Sedition Act @ National Harmony Act.
