Re : Hindraf : Defer and Abolish Death Penalty for all cases and not restricted to trafficking cases.

We refer to the above matter and welcome the government proposal as was reported in the Malay Mail headlines today (25/10/12) “Death sentence deferment proposed. Proposal to defer sentence for drug trafficking convictions to be submitted to Cabinet pending review by attorney-general on abolition of mandatory death penalty under Dangerous Drugs Act” : de facto law Minister Dato Seri Mohamed Nazri Abdul Aziz.
We hereby urge the government of Malaysia to forthwith defer execution of the death sentence on all death row prisoners with the view to review and repeal Section 39(B) of the Dangerous Drugs Act 1952, Firearms Increased Penalty Act Section 302 of the Penal Code (Murder), Kidnapping Act and Treason Act all of which carries the mandatory death penalty.
Our proposal is that a maximum of twenty (20) years imprisonment is punishment enough and is in accordance with the principles of the Universal Crime and Punishment. The abolishment of the death penalty in Malaysia would be consistent with Malaysia being a civil, caring and sharing society.
On 18/10/2012 P.Uthayakumar held watching brief for the family of murder victim Khartic a/l Rajah (25) when Shah Alam High Court Judge Dato Nurchaya binti Arshad passed the death sentence under Section 302 of the Penal Code. The murder victim’s father Mr.V.P. Rajah traumatized by his son’s murder, cried in open Court. And so did the two accused Indonesian national brothers Frans Hiu (25) and Dharry Frully Hui (20) who cried openly when the death sentence was passed.
While the family of Khartic a/l Rajah feels vindicated at the death sentence passed, Hindraf once again calls for the abolishment of the death penalty for all criminal cases and not restricted to drug trafficking cases only.
