Prime Minister Najib Razak makes the “grand announcement” to some 50,000 Indians gathering at Meru,Klang that now SPM students can take Tamil language and literature for a total of 12 SPM subjects. (NST 18/3/13 at page 3,headlines Thina Kural 18/3/13 and other Tamil Dailies).This was in any event allowed until it was disallowed by the Education Minister and Deputy Prime Minister Tan Sri Muhyiddin Yassin in 2012.

Similarly the Indian Studies Department at University Malaya was closed down in2012 and then reopened after Indians go a la begging to the UMNO government.Another case of “now you see it and now you don’t”

Similarly Hindu temples right of existence and co-existence is guaranteed by Article 11 of the Federal Constitution like any of the tens of thousands of Masjids and Suraus. And Najib makes yet another grand announcement that “Since the last election in 2008, we havent’t demolished any (hindu)temple. Wow!Bravo ! (NST 18/3/13 at page 3).

And then Najib goes on to make another “grand announcement” that “Najib noted a huge achievement by the Federal government where it had resolved close to 7,000 cases of stateless Indians in the country”.WOW! (NST 18/3/13 at page 3) But by virtue of Article 14 of the Federal Constitution(Citizenship by operation of law) none of the estimated 450,000 second,third and fourth Malaysian born Indian poor must have been rendered stateless in the first place.

These are the classic tip of the iceberg cases of the UMNO Prime Minister Najib Razak’s grab and give back zero sum political game games maneuver with the Indian poor with the hope of getting free Indian votes in the impending 13th General Elections. Not anymore after the 25th November 2007 Hindraf Rally.

This level of racial politics does not happen in any other part of the world, rendering 1 Malay-sia as the world’s most racist regime.

We refer to the news reports in today’s Makkal Osai and Nam Naadu headlines/ front pages. (23/11/12)

Article 11 of the Malay-sian Federal Constitution guarantees Freedom of Religion. Article 18 of the Universal Declaration of Human Rights 1948 (UDHR) guarantees that “Everyone has the right to freedom of thought, conscience and religion; this right includes freedom to change his religion or belief, either alone or in community with others and in public or private, to manifest his religion or belief in teaching, practice, worship and observance”.

We hereby wish to record our protest on the racist and religious supremacist actions of the Sepang Municipal Council (MPS) Yang Dipertua (YDP) ordering his enforcement team to smash up using sledge hammers even the very small hindu shrine within the private car park compound of the house of Mr.Gopikumar of Sepang, Selangor.

We hereby call upon the Selangor State government to forthwith:-

1) Tender an official apology to the 3 Million Malaysian Hindu community.

2) Pay compensation of RM500,000.00 to Mr.Gopikumar and his family.

3) And sack the Yang Di Pertua of Majlis Perbandaran Sepang as a deterrence to all local Councils nationwide and as a signal that the multi- racial in practice Pakatan Rakyat means business with it’s change @ UBAH policy.

4) A Policy Statement that Pakatan would not tolerate any violations to especially Articles 11 and 18 of the Federal Constitution and UDHR respectively.

5) An undertaking that Pakatan would uphold even greater rights to freedom of religion when it takes over Putrajaya from UMNO in the imminently impending 13th General Elections.

6) Kindly also instruct the Selangor state government to lodge an official police report with the view that criminal prosecution is instituted against the Sepang YDP and the relevant criminals.

Note: Section 295 of the Penal Code stipulates that Injuring or defiling a place of worship with intent to insult the religion of any class is punishable with imprisonment of up to two (2) years, a fine or both.

Kami telah menerima satu aduan daripada Puan R.Saraswathi salah seorang penduduk di kawasan Flat Sri Pulau Pinang Batu 3 ½ Jalan Cheras 56100, Kuala Lumpur yang mengadu kepada kami untuk diajukan kepada pihak tuan seperti berikut:-

1. Bahawa satu unit kedai DBKL di Jalan Ikan Emas, dekat Flat Sri Pulau Pinang yang dikhaskan untuk peniaga kurang mampu ataupun kos rendah DBKL telah dijadikan tempat untuk menjual arak, berjudi sehingga ke larut malam dan maksiat oleh seorang pemilik kedai bernombor 868, Jalan Ikan Emas, Cheras Kuala Lumpur.

2. Kedai tersebut juga terletak berhadapan Surau Flat 1 & 2 Sri Pulau Pinang tersebut. Kedai tersebut difahamkan beroperasi selama 24 jam. Penduduk sekitar mengadu bunyi bising setiap hari yang menganggu ketenteraman awam sehingga tidak boleh tidur dan terpaksa berjaga sepanjang malam.

3. Juga aduan diterima bahawa ada beberapa orang gadis dengan pakaian yang kurang sopan dipercayai Pelayan Bar ( GRO) datang dibawa oleh beberapa orang lelaki pada setiap malam dan berpesta sehingga keesokan hari.Tempat kedai yang sepatutnya diberikan kepada golongan berpendapatan rendah untuk menyara hidup mereka telah disalahgunakan oleh pihak tersebut.

4. Pengadu ada juga mendakwa sudah banyak kali beliau sendiri menghubungi pihak polis kawasan itu dan IPK di talian 03-91722222 dan panggilan dijawab anggota bertugas malam bernama Mohd. Pengadu amat kecewa apabila ada sekurang- kurangnya 3 hingga 4 orang anggota polis yang menaiki motosikal telah datang ke tempat tersebut tetapi langsung tidak menyiasat, menegur atau mengambil tindakan terhadap pemilik premis tersebut malah ada seorang anggota polis diberi salam dan dibawa ke belakang kedai oleh salah seorang pengendali kedai tersebut dan sejurus kemudian beredar daripada tempat itu dengan serta merta.

5. Kegiatan menjual arak berleluasa sehingga ada remaja yang masih dibangku sekolah juga turut serta dalam aktiviti judi dan meminum arak tersebut.

Kami dengan ini menggesa Y. Bhg Ketua Polis Negara dan Y. Bhg Dato Bandar Kuala Lumpur untuk melucutkan lesen premis tersebut dan mengambil tindakan yang sewajarnya pada kadar segera.

We refer to the above matter wherein the apex Federal Court had yesterday (10/10/12) dismissed the leave to appeal application to Anuar bin Sarip’s widow Puan Suzana binti Mohd Aris of almost RM 1.6 Millon damages awarded by the Kuala Lumpur High Court for Anuar bin Sarip’s death at the Selayang police station lock up after vomiting blood and never taken to the General Hospital. (Utusan Malaysia 11/10/10 at page 24).

This brings to a finality this 13 year old struggle for Justice almost single handely by this one widow versus the whole weight and might of the very powerful state.

SAM_1914 Our office file itself has piled up to about four (4) feet in these 13 years struggle for justices. For the records on our part SAM_1915we have not collected a single cent from the widow, not even the filing fees or disbursements..

In the circumstances our client and her two orphaned children hereby appeal that the government of Malaysia shows compassion by way an gratia payment of RM 400,000.00 (about 25% of the said RM 1.6 Million and about the sum that was affirmed by the Court of Appeal all in the case of R. Sundararaju’s death in the Klang police lock up case).

S Mogan claims that he has no reason to lie about being assaulted by police and Rela personnel.

KUALA LUMPUR: The 42-year-old mechanic who claimed to have been assaulted by the People’s Volunteer Corps (Rela) personnel and policemen has defended his story, refuting the police’s version of what transpired.

Commenting on the police’s suggestion that he might have filed a false report, S Mogan told FMT that he had no reason to make up such a story.

“What can I do if they want to accuse me of lying? I don’t know. If my report was false how can my leg be broken? Why would I want to play with them? I don’t have anything against them. I didn’t know these cops before this. Which idiot would break his own leg just to do all this? Its not an old wound either,” he said.

Asked about the police records that showed that the three policemen Mogan had named earlier did not even come to work until 8am, he said:” Yes, before 8am there was a Malay cop and later only the three came. They all beat me.”

“If I hated the police, I could even say that the Kajang police beat me, but they didn’t touch me, they were very professional. One of them even gave me water and told me if it was up to him, he would release me because I did not look like a crook,” he added.

On the Rela personnel’s testimony that Mogan had ran off when he was spotted climbing into a TNB substation, Mogan said it was untrue.

“No, I did not run away, I surrendered myself to them. Why would I run, my car was parked there. Why would I run? I have done nothing wrong, I did not possess anything illegal. And why would I climb into a power station, if I touch that I will die, I am not so stupid to touch it or climb it,” he added.

Respected man in the neighbourhood

Mogan reiterated that he was not a criminal and that he was a family man who was well-known in his area in Balakong.

“Come and see my workshop, come to my neighborhood, everybody can testify what I do for a living. Nobody will say anyhing bad about me. I got two kids, I need to earn a living and that’s all I do. Yes I smoke, but I don’t even drink alchohol,” he said.

Asked about the police’s suspicion why he had lodged a report and gone to the hospital much later if his leg was really fractured, Mogan replied:”At first I did not know it was broken. My wife helped me put traditional medicine the first two days, it was not four days like the police said. Only when I went to the hospital did I know it was so serious.”

Yesterday, police revealed that the initial investigations on the alleged assault on Mogan showed discrepancies between his version and that of the law enforcers, indicating that he might not have been assaulted.

However, police had stressed that their investigations would not be closed until Mogan’s statement had been recorded..

On Feb 16, Mogan was allegedly subjected to hours of torture by law enforcement officers including having a gun pointed to his head to force a confession out of him.

Mr. Munisvaram a/l A. Pachaiapan informs us that his natural son Eswaran’s Birth Certificate No. 041123-14-1569 ( No Daftar BQ 24370) unlawfully classifies him as a non citizen and does not carry Mr. Munisvaram a/l A. Pachaiapan’s name as the natural father in the father’s name column. (copy of Birth Certificate enclosed) This

because he earlier could not register his marriage to Madam Kalavathi James an Indian citizen due to the Registrar of Marriages refusing to register his marriage.

Please Take Note that Article 14 of the Federal Constitution guarantees citizenship by operation of law

Article 14 (1) (b) Part II (Section 1 (a) stipulates:-

Citizenship By Operation of Law of Persons Born on or after Malaysia Day

Subject to the provisions of Part III of this Constitution, the following persons born on or after Malaysia Day are citizens by operation of law, that is to say:

a) every person born within the Federation of whose parents one at least is at the time of the birth either a citizen or permanently resident in the Federation;

In the circumstances kindly therefore forthwith issue to Mr. Muniswaran a/l A. Pachaiapan’s son Eswaran his due Birth Certificate with his citizenship status as a Malaysian and the name of Muniswaran as the natural father according in the Birth Certificate of Eswaran.

Please take note that Eswaran’s (8) difficulty in being enrolled in a primary schools appears to be at the mercy of the school authorities. The school authorities have since informed Mr. Muniswaran that his son would be dismissed from school and cannot continue with Standard Three with effect from 1/1/2013 if his Citizenship status in his Birth Certificate is not classified as a Malaysian by then.

Mr. Muniswaran can be directly contacted at Mobile No. 016-6179925.

In the interim kindly issue a policy circular to the Director General of the National Registration Department to forthwith grant the long outstanding Birth Certificates, Identity Cards and Citizenship illegally denied to the estimated 450,000 stateless Malaysian born Indian poor and their parents.

It is a national shame that the Indian poor in 1 Malay-sia are still being made to beg for even this their innate right to their lawful and legitimate Birth Certificates, Identity Cards and Citizenship despite 55 years of Merdeka.

Your goodselves kind indulgence in this matter would be greatly appreciated.
